By accessing or using SLCTrips ("Service", "Platform", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

SLCTrips is a digital platform providing curated travel content and planning resources for exploring Utah destinations. Our services include:

2.1 TripKit Products

TK-000 Guardian County Profiles: Free educational content featuring county guardians and educational narratives appropriate for 4th-grade level students
Premium TripKits: Paid digital content packages featuring curated itineraries, destination guides, deep-dive stories, and specialized travel planning resources
Destination Database: Searchable database of Utah travel destinations with descriptions, photos, and user-generated content

2.2 User Features

User account creation and authentication
TripKit purchases and downloads
Access to Guardian educational content
Interactive maps and destination discovery tools

3. User Accounts

3.1 Account Creation

You must provide accurate and complete information when creating an account
You are responsible for maintaining the security of your account credentials
You must be at least 13 years old to create an account
One person may not maintain more than one account

3.2 Account Responsibilities

You are responsible for all activities that occur under your account
You must notify us immediately of any unauthorized use of your account
We reserve the right to suspend or terminate accounts that violate these Terms

3.3 Account Termination

You may close your account at any time by contacting support
We may suspend or terminate your account if you violate these Terms
Upon termination, you will lose access to purchased content (subject to refund policy)

4. Purchases and Payments

4.1 Payment Processing

All payments are processed securely through Stripe
By making a purchase, you agree to provide accurate payment information
You authorize us to charge your payment method for all purchases

4.2 Pricing

All prices are listed in USD
Prices are subject to change with reasonable notice
Special promotional pricing may be offered at our discretion

4.3 TripKit Licenses

TripKit purchases grant you a personal, non-transferable license
You may access purchased content indefinitely while your account remains active
Content may be used for personal travel planning only

4.4 Refunds

Our refund policy is detailed in our Refund Policy
Digital content purchases are generally non-refundable after download
We may offer refunds at our discretion for exceptional circumstances

5. Intellectual Property Rights

5.1 SLCTrips Content

All content on the Platform, including text, images, graphics, logos, Guardian narratives, and TripKit materials, is owned by SLCTrips or our licensors
Content is protected by United States and international copyright laws
You may not reproduce, distribute, modify, or create derivative works without written permission

5.2 User License

We grant you a limited, non-exclusive, non-transferable license to access and use purchased content for personal use
You may not:
- Resell, redistribute, or share purchased content
- Remove copyright or proprietary notices
- Use content for commercial purposes
- Create derivative works based on our content

5.3 Guardian Characters and Narratives

All Guardian characters, names, backstories, and educational narratives are proprietary to SLCTrips
Guardian content may not be used in other educational materials without permission

5.4 User-Generated Content

You retain ownership of any content you submit (reviews, comments, photos)
By submitting content, you grant us a worldwide, royalty-free license to use, reproduce, and display your content in connection with the Service
You represent that you have the right to submit such content

6. Acceptable Use Policy

You agree NOT to:

Violate any laws or regulations
Infringe on intellectual property rights
Transmit malicious code or viruses
Attempt to gain unauthorized access to our systems
Harass, abuse, or harm other users
Use the Service for commercial purposes without permission
Create fake accounts or impersonate others
Scrape or data mine the Platform
Interfere with the proper functioning of the Service
Share account credentials with others
Circumvent any access restrictions or copy protection

7. Guardian Educational Content

7.1 Educational Purpose

Guardian content is designed for educational purposes appropriate for 4th-grade level students
Content aims to teach Utah geography, history, and culture in an engaging format

7.2 Parental Guidance

While content is age-appropriate, we recommend parental supervision for younger users
Parents/guardians are responsible for monitoring children's use of the Service

7.3 Accuracy

We strive for historical and geographical accuracy in educational content
Guardian narratives blend factual information with creative storytelling elements

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability
Fitness for a particular purpose
Non-infringement
Accuracy or completeness of content

8.2 Travel Information

Destination information, photos, and descriptions are provided for informational purposes only
We do not guarantee the accuracy, completeness, or timeliness of travel information
Destinations, hours, and conditions may change without notice
You are responsible for verifying current information before traveling

8.3 Third-Party Content

We may display content from third-party sources (reviews, photos, descriptions)
We are not responsible for third-party content accuracy or quality
Third-party links are provided for convenience only

8.4 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SLCTRIPS SHALL NOT BE LIABLE FOR:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, revenue, data, or use
Damages arising from your use or inability to use the Service
Damages resulting from travel decisions made based on Platform content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS PRECEDING THE CLAIM.

8.5 Travel Risks

You acknowledge that travel involves inherent risks
You are solely responsible for travel decisions and safety precautions
We are not liable for accidents, injuries, or losses incurred during travel
You should obtain appropriate travel insurance

9. Indemnification

You agree to indemnify, defend, and hold harmless SLCTrips, its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your violation of these Terms
Your violation of any rights of another party
Your use of the Service
Your user-generated content

10. Privacy and Data Protection

Your privacy is important to us
Our collection and use of personal information is governed by our Privacy Policy
By using the Service, you consent to our data practices as described in the Privacy Policy

11. Digital Millennium Copyright Act (DMCA)

11.1 Copyright Infringement Claims

If you believe content on our Platform infringes your copyright, please provide:

13.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of state and federal courts located in Utah for resolution of any disputes.

13.3 Dispute Resolution Process

Before filing any legal action:

Contact us to attempt informal resolution
Provide detailed description of the dispute
Allow 30 days for good faith negotiation

13.4 Class Action Waiver

You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.

14. Miscellaneous

14.1 Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and SLCTrips.

14.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

14.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

14.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control.

14.6 Survival

Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, and indemnification).
